- Disputes are resolved through binding individual arbitration, not class actions — see Section 33 and 34.

Important Notice: MyEyeRx facilitates medical window tint exemption consultations and related administrative services. Use of this website or purchase of a consultation does not guarantee medical approval, issuance of documentation, or acceptance by any DMV, law-enforcement officer, court, or other government agency. All medical decisions are made by the evaluating provider, and all legal compliance remains the responsibility of the user.
Welcome to MyEyeRx.net (“MyEyeRx,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, services, consultations, products, forms, communications, and related offerings (collectively, the “Services”).
By accessing or using MyEyeRx.net, submitting a form, scheduling a consultation, purchasing a Service, or otherwise interacting with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Acceptance of These Terms
These Terms form a legally binding agreement between you and My Eye Rx (“MyEyeRx”) regarding your use of MyEyeRx.net and any Services offered through the website. By accessing, browsing, creating an account, scheduling a consultation, submitting a form, or purchasing a Service, you represent and warrant that:
- You are at least eighteen (18) years old, or are using the Services with the direct involvement and authorization of a parent or legal guardian where permitted by law.
- You have the legal capacity and authority to enter into a binding agreement.
- All information you provide is truthful, accurate, current, and complete.
- Your use of the Services does not violate any applicable law or the rights of any third party.
If you are using the Services on behalf of another person or entity (for example, a parent scheduling for a minor), you represent that you have full legal authority to do so and to bind that person or entity to these Terms.
2. Definitions
- “Consultation” means a live or asynchronous medical evaluation performed by a licensed provider engaged through MyEyeRx.
- “Provider” means the independent licensed clinician who performs the Consultation and exercises sole clinical judgment.
- “Documentation” means any letter, form, prescription, or written output prepared by the Provider following a Consultation.
- “User,” “you,” or “your” means the person accessing or purchasing the Services.
- “Content” means text, images, graphics, audio, video, data, and other materials available through the Services.
3. Nature of the Service — Consultation Only
MyEyeRx provides administrative and technology services that help you connect with a licensed Provider for a Consultation related to medical window tint exemptions, optical evaluations, and related eye-care needs. MyEyeRx is not a law firm, not a DMV, not a tint installer, and not a pharmacy. We do not practice medicine, provide legal advice, install or sell tint film, determine which tint level is safe for your vehicle, or issue government documents.
Your purchase is payment for the Consultation (and associated administrative work), not payment for a particular clinical outcome or a guaranteed document.
4. No Guarantee of Approval or Government Acceptance
We do not guarantee, and you should not assume, that:
- You will qualify for a medical exemption;
- A Provider will issue any particular Documentation;
- Any DMV, law-enforcement agency, court, prosecutor, judge, or other authority will accept, honor, or refuse to ticket you based on the Documentation;
- Any particular window-tint level will be approved, lawful, or safe in your state, vehicle, or circumstances.
Acceptance of Documentation is entirely within the discretion of the reviewing authority, which is outside our control.
5. Medical Providers and Clinical Decisions
Consultations are performed by independent licensed Providers. Providers exercise their own independent medical judgment and may decline to issue Documentation, may issue Documentation with limitations or exclusions, may require additional information, or may refer you elsewhere. MyEyeRx does not direct, influence, override, or second-guess any Provider’s clinical decision, and a refusal by a Provider does not entitle you to a refund beyond what is stated in Section 15.
6. Not Medical Advice; No Emergency Services
Content on MyEyeRx.net is provided for general informational purposes only and is not medical advice, diagnosis, or treatment. Always consult a qualified clinician with questions about your health. The Services are not appropriate for emergencies. If you are experiencing sudden vision loss, eye trauma, severe headache, or any other medical emergency, call 911 or go to the nearest emergency room immediately.
7. Eligibility Requirements
To use the Services, you must (a) be at least 18 years old or use the Services under the authority of a parent or legal guardian, (b) reside in a state in which we offer the Services (see Section 8), (c) be legally capable of entering into a binding contract, and (d) not be barred from receiving the Services under applicable law. We reserve the right to decline, restrict, or suspend Service availability to any user for any lawful reason.
8. State-Specific Availability
The Services are offered only in U.S. states where we and our Providers are authorized to operate. Availability, scope, and pricing vary by state. Nothing on the website constitutes an offer to provide Services in a state where such offer would be unlawful. 9. User Responsibilities & Accuracy of Information
You agree to:
- Provide truthful, current, and complete information at all stages, including intake, scheduling, payment, and post-Consultation follow-up;
- Submit only documents and records you are legally authorized to provide;
- Attend scheduled Consultations on time and in an environment suitable for a medical visit;
- Follow all lawful instructions from MyEyeRx and the Provider regarding scheduling, documentation, payment, and communication;
- Update your information if it changes, and promptly correct any inaccuracies;
- Use the Services only for lawful purposes and in accordance with these Terms.
Submitting false, forged, altered, or materially incomplete information may result in refusal of service, revocation of Documentation, forfeiture of fees, and referral to appropriate authorities.
10. Prohibited Uses
You may not (and may not authorize or assist any third party to):
- Use the Services to defraud, mislead, harass, or harm any person;
- Impersonate another person or misrepresent your affiliation with any person or entity;
- Submit false or altered medical records, identifications, or supporting documents;
- Attempt to circumvent, disable, or interfere with security features of the website;
- Reverse-engineer, scrape, crawl, or harvest data from the Services except as expressly permitted;
- Upload malware, viruses, or any other harmful code;
- Use the Services to violate any applicable federal, state, local, or international law;
- Resell, sublicense, or commercially exploit the Services without our prior written consent.
11. Screening and Documentation Requirements
You may be asked to complete intake forms, upload identification, provide insurance information (if applicable), or submit photographs or medical records before, during, or after a Consultation. You are responsible for making sure submitted materials are legible, accurate, and belong to you. If required materials are missing, illegible, or unverifiable, your Consultation may be delayed, rescheduled, or canceled.
12. Communications Consent (Calls, SMS, Email)
By providing your phone number or email address, you consent to receive transactional, appointment-related, and service-related communications from MyEyeRx and our service partners, including by telephone, SMS/MMS, email, and push notification. Message and data rates may apply. You may opt out of promotional messages at any time; transactional and safety messages may continue where permitted by law. SMS opt-out instructions are included in each marketing message (reply STOP to unsubscribe; HELP for help).
13. Consultation Platform and Recording Consent
Consultations may be conducted by phone, video, or asynchronous messaging via our telehealth vendors. By participating, you agree that your Consultation may be recorded or transcribed for medical, quality-assurance, compliance, or dispute-resolution purposes, to the extent permitted by law. Recordings are treated as protected health information (see Section 19) and retained according to our retention schedule. If you do not consent to recording, notify us in writing before your Consultation.
14. Fees, Payments, and Billing
All fees are disclosed at the time of purchase and are payable in U.S. dollars. By providing payment information, you authorize MyEyeRx and our payment processors to charge the specified amount plus any applicable taxes. Fees may change from time to time; the fees in effect at the time of your purchase govern that purchase. You are responsible for keeping your payment information current. If a payment fails, we may suspend or cancel your Consultation until payment is received. Chargebacks initiated without first contacting us may be disputed and, if found invalid, may result in account termination and collection activity.
15. Refunds and Cancellations
Refund eligibility and timing are governed by our Refund Policy, which is incorporated by reference. In general, a non-refundable processing fee of $35 applies to eligible refunds to cover payment-processor, platform, and administrative costs. Refunds are not available after the Consultation has occurred, after Documentation has been issued, or where prohibited by law. Cancellation windows and reschedule policies are posted at checkout and in your confirmation email.
16. Shipping, Fulfillment, and Delivery
Physical items (such as prescription eyeglasses or printed Documentation) are fulfilled by MyEyeRx or an authorized vendor and shipped to the address you provide. Ship times are estimates, not guarantees. Risk of loss transfers to you upon carrier pickup. You are responsible for providing a correct, deliverable address. Returned packages due to incorrect addresses may incur reshipment fees. If an item arrives damaged or defective, contact us within fourteen (14) days with photos for evaluation.
17. State Law and Compliance Disclaimer
Window-tint and medical-exemption laws vary widely by state and change frequently. MyEyeRx provides general information and Documentation facilitation; we do not provide legal advice. You are solely responsible for understanding and complying with the laws applicable to you, including tint-darkness limits, labeling requirements, vehicle-type restrictions, carry requirements, and DMV registration processes. Our State Exemption Guides are informational only and may not reflect the most recent statutory or regulatory changes.
18. Safe Operation of Vehicle
Even if you receive Documentation, you are solely responsible for the safe operation of your vehicle. This includes making sure that tint levels do not impair your ability to see clearly in all conditions (including at night, in rain, and into mirrors). Do not drive if tinted windows impair your ability to see or operate the vehicle safely. MyEyeRx disclaims any responsibility for crashes, citations, injuries, or property damage resulting from your vehicle modifications or driving.
19. HIPAA and Protected Health Information
Information collected during Consultations may constitute Protected Health Information (“PHI”) under the Health Insurance Portability and Accountability Act (“HIPAA”). We and our Providers handle PHI in accordance with HIPAA and applicable state privacy laws. Our Privacy Policy describes what PHI and other information we collect, how we use and disclose it, and the choices available to you. By using the Services, you acknowledge that you have reviewed our Privacy Policy.
20. Third-Party Services and Payment Processors
We rely on third-party vendors for payment processing, scheduling, video conferencing, SMS, email, analytics, and similar operational needs. Your interactions with these vendors are governed by their own terms and privacy policies. We are not responsible for the acts, omissions, outages, security incidents, or policies of third parties except to the extent required by law or by our written agreements with them. Links to third-party websites are provided for convenience only and do not constitute an endorsement.
21. Intellectual Property Rights
All Content on the website — including text, graphics, logos, trademarks, photographs, audio, video, software, and compilations — is the property of MyEyeRx or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. Except for your personal, non-commercial use as expressly permitted, you may not reproduce, modify, distribute, republish, scrape, frame, transmit, or otherwise exploit any Content without our prior written permission. The MyEyeRx name and logo are our trademarks; all rights reserved.
22. User-Submitted Content and License
You retain ownership of information and materials you submit (“User Content”), but by submitting User Content, you grant MyEyeRx a worldwide, royalty-free, non-exclusive license to use, reproduce, store, transmit, and display that User Content to the extent necessary to provide the Services, comply with law, and resolve disputes. You represent and warrant that you have all rights necessary to grant this license and that the User Content does not violate any law or third-party right.
23. Privacy Policy
Our Privacy Policy is incorporated into these Terms by reference and describes how we collect, use, share, and protect information about you. By using the Services, you acknowledge and agree to our Privacy Policy.
25. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, OR ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. Without limiting the foregoing, we do not warrant that:
- The Services will be uninterrupted, timely, secure, or error-free;
- Consultations will result in Documentation, or that any Documentation will be accepted by any agency;
- Information on the website will always be accurate, complete, current, or suitable for your situation;
- Defects will be corrected, or that the Services are free of viruses or other harmful components.
26. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MYEYERX AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, PROVIDERS, AND SERVICE PROVIDERS (COLLECTIVELY, THE “RELEASED PARTIES”) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MYEYERX FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
27. Indemnification
You agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your misuse of the Services; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party right, including privacy, publicity, or intellectual-property rights; (d) any information or documents you submit; (e) your vehicle modifications or use of any Documentation obtained through the Services; and (f) any interaction between you and a Provider. We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification.
28. Account Suspension and Termination
We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms, submitted inaccurate information, engaged in abusive conduct, or created risk to MyEyeRx or its users. Upon termination, all rights granted to you under these Terms cease immediately, but Sections that by their nature should survive termination (including Sections 14, 15, 21, 25-30, 33-34, 38-43) will survive.
29. Force Majeure
We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, utility outages, internet or telecommunications failures, governmental actions, or failures of third-party vendors.
30. Assignment
You may not assign or transfer these Terms or any rights or obligations under them, by operation of law or otherwise, without our prior written consent. We may assign these Terms, in whole or in part, without notice to you, including in connection with a merger, acquisition, reorganization, financing, or sale of assets. Any attempted assignment in violation of this Section is void.
31. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules, and the laws of the United States applicable therein. Subject to the arbitration provisions below, the state and federal courts located in Wayne County, Michigan will have exclusive jurisdiction and venue for any action not subject to arbitration, and you consent to personal jurisdiction in those courts.
32. Dispute Resolution — Informal Resolution First
Before filing any claim against MyEyeRx, you agree to first attempt to resolve the dispute informally by contacting us at Tory@myeyerx.net with a written description of the claim, your contact information, and the specific relief sought. We will attempt in good faith to resolve the dispute within sixty (60) days. Only if the dispute is not resolved within that period may either party initiate a formal proceeding subject to Section 33.
33. Binding Arbitration Agreement
Please read this Section carefully. It affects your legal rights. Except for disputes qualifying for small-claims court and except for actions seeking injunctive relief for intellectual-property infringement, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, not in court. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted in the English language and seated in Wayne County, Michigan, unless otherwise agreed. The arbitrator — and not any federal, state, or local court or agency — will have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement. Judgment on the award may be entered in any court of competent jurisdiction.
34. Class Action and Jury Trial Waiver
YOU AND MYEYERX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. You and MyEyeRx also each waive any right to a trial by jury.
30-Day Opt-Out Right. You may opt out of this arbitration agreement and class-action waiver by sending written notice to MyEyeRx at the contact address in Section 43 within thirty (30) days of first accepting these Terms. Your notice must include your full legal name, address, email, and a clear statement that you wish to opt out of arbitration.
35. Electronic Signatures and Records (E-SIGN)
You consent to transact with us electronically and agree that electronic signatures, contracts, and other records have the same legal effect, validity, and enforceability as manually signed paper documents, consistent with the federal E-SIGN Act and applicable state Uniform Electronic Transactions Acts. You can withdraw this consent at any time by writing to us at the contact address in Section 43, but doing so may prevent you from using the Services.
36. Accessibility Statement (ADA/WCAG)
MyEyeRx is committed to digital accessibility and strives to conform to Level AA of the Web Content Accessibility Guidelines (WCAG) 2.1. If you encounter any barrier to using our website, please contact us at Tory@myeyerx.net with a description of the issue and the URL where it occurred, and we will work promptly to address it.
37. California Consumer Privacy Rights (CCPA/CPRA)
California residents have additional rights under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the “CCPA”), including the right to know, delete, correct, and opt out of the sale or sharing of personal information, and to limit the use of sensitive personal information. To exercise these rights, see the “Your Privacy Choices” section of our Privacy Policy or contact us at Tory@myeyerx.net. We will not discriminate against you for exercising your CCPA rights.
38. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable in any respect, that provision will be modified to the minimum extent necessary to make it enforceable, or, if that is not possible, severed; and the remaining provisions will continue in full force and effect.
39. No Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. A waiver is effective only if expressly granted by us in writing.
40. Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, and any additional terms or policies referenced herein or presented at checkout, constitute the entire agreement between you and MyEyeRx regarding the Services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
41. Modifications to These Terms
We may modify these Terms from time to time. The updated Terms will be posted on this page with a new “Last Updated” date. Material changes will be communicated by email or prominent notice on the website where we reasonably can. Your continued use of the Services after revised Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by law. If you do not agree to the revised Terms, you must stop using the Services.
42. Notices
Notices to you may be provided by email (to the address associated with your account), by posting to the website, or by U.S. mail. Notices to us must be sent to the address in Section 43 and will be deemed given upon receipt.
